Discrimination & Protected Categories: Proactive Management

Managers and supervisors don't always have the time or tools to consider how their business decisions and communications can be perceived negatively by others. This can be particularly problematic with decisions about hiring, promotion, discipline, performance evaluations and termination.  Being unprepared to communicate properly about how and why those decisions were made can readily lead to a breakdown in relationships and, in worst case scenarios, discrimination claims. 

By taking time in advance to create a communication strategy, people managers can minimize those risks.  Proactive managers make sound business judgments based on best practices and are able to communicate their decision making processes in ways that can prevent allegations of discrimination from arising in the first place.   

This course gives participants an overview of the major workplace discrimination laws and the protected categories under those laws.  Included are overviews of Title VII, the ADEA, the ADA, GINA, the FMLA and equal pay laws, and how those laws are implicated at work every day in almost every management decision.  Participants learn how a practical understanding of the concepts underlying those laws can help them communicate and manage better on an ongoing basis and enhance workplace relationships while reducing risk.

Large and small group discussions engage participants in joint problem solving using real-life case scenarios and hypotheticals.  Referring to your company’s policies and philosophy of the value placed on employment relationships, the course can be customized to your workplace, culture and industry.  The course can also be customized to include workplace harassment and an overview of the foundation of the employment relationship. That material is used to demonstrate the interrelationship between discrimination, harassment and at will employment and how to anticipate and address potential issues before they arise.
